The article explores the main legal implications that may arise from the connection between staff secondment and corporate administrative liability, with particular attention to the dynamics of multinational groups.
The piece is inspired by the recent analysis published by Assonime in “Case 7/2024”, and focuses on three main aspects:
• The criteria for attributing liability to the company in the event of an offence;
• The conditions under which Italian jurisdiction may apply;
• The organizational and preventive measures that Italian companies can adopt to reduce the risk of criminal liability when seconding workers abroad.
The goal is to provide a practical and up-to-date framework to help companies manage international staff secondments in a compliant and well-informed manner.
